Terms And Conditions
1. AGE LIMIT:
1.1. No one under the age of twenty-five (25) is permitted to drive or operate the rented vehicle.
1.2. All drivers must have a valid driver’s license that is at least two (2) years old and must not have any endorsements. A valid home license is accepted for driving in Jamaica.
2. ADDITIONAL DRIVER:
2.1. The Renter may authorize one (1) additional person to operate the vehicle, subject to the following conditions:
– An Atlas Logistics & Service Centre representative must meet with and photocopy their driver’s license.
– The additional driver(s) will share equal responsibility for the vehicle and must adhere to the terms and conditions outlined in this rental agreement.
– If the rented vehicle is seen being driven by an unauthorized driver, Atlas Logistics & Service Centre reserves the right to seize the vehicle without recourse to the Renter.
3. FUEL:
3.1. It is company policy to provide a full tank of petrol. A deposit will be taken for this, and you will be refunded in full upon returning the vehicle with a full tank. Vehicles returned with less than a full tank of petrol will incur a service charge plus the cost of refueling.
4. RENTAL PERIOD:
4.1. One day’s rental equals twenty-four (24) hours. Therefore, a vehicle rented at 12:00 am on Monday should be returned at 12:00 am on Tuesday.
4.2. A maximum one-hour grace period is allowed without an additional charge, provided it falls within Atlas Logistics & Service Centre’s operational hours.
4.3. Beyond the one-hour grace period and up to four (4) hours will be subject to hourly rates as set by Atlas Logistics & Service Centre, equivalent to one-quarter of the daily rates.
4.4. Rentals exceeding four hours will be considered an extra day’s rental.
4.5. Failure to return the vehicle on the due date or within 24 hours of a written or oral demand by Atlas Logistics & Service Centre will result in the vehicle being reported as stolen. The rented vehicle must be returned to an Atlas Logistics & Service Centre representative.
5. USE OF VEHICLE:
5.1. The vehicle must not be driven or operated by any unauthorized person.
5.2. The vehicle should not be driven or operated under the following conditions:
– With a revoked or suspended license.
– For commercial purposes or transporting people or property for compensation.
– For giving driving lessons.
– For any illegal activities.
6. LIABILITY PROTECTION:
6.1. The Renter is solely responsible for all liabilities, damages, and claims arising from the use of the rented vehicle during the rental period.
6.2. The Renter agrees to indemnify and hold harmless Atlas Logistics & Service Centre from any and all claims, losses, expenses, damages, and liabilities, including legal fees, arising from the Renter’s use of the vehicle.
7. DAMAGE RESPONSIBILITY:
7.1. The Renter is responsible for all damages and defects on the vehicle, including tire damage, occurring during the rental period.
8. ACCIDENTS:
8.1. In the event of an accident, the Renter must promptly report it to Atlas Logistics & Service Centre and the police. The Renter should deliver all documents relating to any claim or legal action arising from the accident and cooperate with Atlas Logistics & Service Centre and its insurers in the investigation and defense of any claims. The Renter must complete an accident/loss report within 24 hours of the accident. Daily charges will continue until the vehicle and keys are returned.
9. EXTENSION POLICY:
9.1. Customers wishing to extend the rental period must contact Atlas Logistics & Service Centre’s office before the rental contract ends to make payment and have a new contract issued.
10. CANCELLATION / REFUND POLICY:
10.1. Cancellations must be made at least twenty-four (24) hours before the start of the rental contract.
10.2. In case of cancellation, all charges will be refunded except for the non-refundable administration fee, which will be charged to the credit card provided for booking. Refunds will not be issued to third-party credit cards.
11. CONDITION OF VEHICLE:
11.1. Vehicles must be returned in the same condition as received. Excessive staining or damage to the interior will incur additional charges.
12. QUALIFICATIONS:
12.1. The Renter affirms that they are physically and legally qualified to operate the rented vehicle.
13. EXCLUSIONS:
13.1. The rented vehicle shall not be used to carry passengers or property for hire.
13.2. The rented vehicle shall not be used to carry passengers other than in the interior or cab of the vehicle.
13.3. The rented vehicle shall not be used to push, propel, or tow another vehicle, trailer, or any other thing without the written permission of the Owner.
13.4. The rented vehicle shall not be used for any race or in any competition.
13.5. The rented vehicle shall not be used for any illegal purpose.
13.6. The Renter shall not operate the vehicle in a negligent manner.
13.7. The rented vehicle shall not be operated by any other person other than the Renter stipulated in 1.2 above without the written permission of the Owner. If the Renter allows any other driver to drive the rented vehicle, the Renter will be fully responsible for all expenses relating to the rental car and any other vehicle involved in any type of accident.
13.8. The principles set out in Avis Rent-a-Car v Maitland (1980) 32 WLR 294 shall apply for the benefit of the Owner.
14. INSURANCE:
14.1. The Renter hereby agrees that they shall be held fully responsible for the deductible in case of an accident. The Renter also agrees that only the other vehicle (the vehicle that is the co-party in an accident) is covered under insurance, and the primary vehicle, driver or passengers are not covered. The Renter also agrees that personal belongings and other items left in the vehicle at any time are not covered.
15. DEPOSIT:
15.1. The Renter further agrees to make a deposit of at least 3 day’s rental with the Owner. Said deposit shall be used, in the event of loss,cleaning of or damage to the vehicle.
